I don’t even know where to begin with this entire case. I guess the cliffnotes here consist of an activist group of Pro-Life doctors who sued because they don’t want to provide medical care to women who may need an OB/GYN for post-abortion healthcare. That is really the center of the argument.
So what they did was take the most popular method of abortion in America (the abortion pill) and they sued the FDA basically stating that new/evolved guidelines (many of which came during COVID) were dangerous to women.
And by the FDA rolling back those few recommendations, we have seen an increase in providers (like these doctors) having to treat women post-abortion or in the middle of a medical abortion in an emergency room kind of setting. As if there isn’t already a conscientious objection policy in place for physicians.
One of the reasons they cited in this lawsuit against the FDA is that since 2020 when the FDA rolled back certain recommendations of the drug, there has been a substantial increase in ER visits due to abortions.
While also completely leaving out the fact that since the start of the pandemic there has been a glaring highlight on a system that is broken, and has only become worse before our eyes. Not only does obstetric care for women in America fall behind most developed nations, but we continue to have worse outcomes. In many cases merely because women don’t have access to basic healthcare.
They don’t have health insurance, a primary care doctor, even an OB/GYN.
In America, many people have no opportunity but to use the emergency room for their basic healthcare needs. Is it effective? No. Is it a realistic manner to handle healthcare? Absolutely not. Is it all some people have? Yup.
The entire case as a whole completely ignores that we are having a healthcare crisis because all they care about is further restricting women’s access to basic prescription drugs.
While the Justices continued to sound skeptical during the duration of the questioning, I always continue to be leary of this court… rightfully so.
Additionally I wanted to highlight the fact that it is abundantly clear if these doctors cannot deliver the bare minimum of lifesaving care to patients, maybe they shouldn’t be working in a setting where their own convictions or personal beliefs could cost another person their life.
Do not harm.
Maybe it’s time to boot religious based physicians since it is becoming more and more clear they cannot do their job properly.
In the case that the SCOTUS does rule against the FDA, the expansive impacts this will have will ripple across America when it comes to prescription drugs. This will not just impact Mifepristone. This will impact any and all FDA approves drugs.
Choose wisely, SCOTUS.
This could be another stain on your robes.
